Terms of Service

Please read these Terms of Service ("Terms") carefully before using Horror Quest (the "Service"), a Discord Activity developed and operated by Nick Loubser ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By launching, joining, or otherwise using Horror Quest within Discord, you confirm that you have read, understood, and agree to these Terms. These Terms constitute a legally binding agreement between you and us.

2. Description of Service

Horror Quest is an embedded Activity that runs inside Discord voice channels. It is a multiplayer horror murder mystery game in which players investigate AI-generated crime scenes, vote on actions, and attempt to identify a fictional murderer before their in-game character perishes.

The Service includes:

• AI-generated story content, scenes, and character dialogue
• AI-generated scene imagery rendered per chapter
• AI-powered text-to-speech narration
• Real-time multiplayer voting and game state synchronization

3. Discord Integration & Third-Party Platform

Horror Quest operates exclusively within the Discord platform. By using the Service, you are also subject to Discord's Terms of Service and Discord's Privacy Policy. We are not affiliated with Discord Inc.

We access your Discord account information solely to the extent required to operate the game session (see our Privacy Policy).

4. Eligibility

You must be at least 13 years of age — or the minimum age required in your jurisdiction to use Discord — to access or play Horror Quest. By using the Service, you represent that you meet this requirement.

Horror Quest contains horror themes, atmospheric depictions of death, mystery, and suspense. It is intended for players who are comfortable with fictional horror content. No graphic, sexual, or illegal content is generated or displayed.

5. Acceptable Use

You agree not to:

• Attempt to exploit, reverse-engineer, or circumvent any part of the Service
• Use the Service in any manner that violates applicable laws or regulations
• Attempt to interfere with or disrupt the multiplayer game sessions of other players
• Abuse, harass, or harm other players through any means within or related to the Service
• Use automated bots, scripts, or tools to interact with the Service

We reserve the right to block or restrict access for users who violate these rules.

6. AI-Generated Content

All story content, imagery, and narration in Horror Quest is generated by third-party AI services (Google Gemini and Imagen). This content is procedurally created and is entirely fictional. We make no representations about the accuracy, consistency, or appropriateness of AI-generated content beyond what is technically filtered at the API level.

You acknowledge that AI-generated content may occasionally be unexpected, repetitive, or imperfect. This is inherent to the technology and does not constitute a defect in the Service.

7. Intellectual Property

The Horror Quest name, logo, visual design, and original code are the property of Nick Loubser. All rights reserved. AI-generated story and image content is generated dynamically and is not stored or claimed by us beyond the active game session.

You may not reproduce, distribute, or create derivative works from any element of the Service without our express written permission.

8. Service Availability

We provide the Service on an "as available" basis. We do not guarantee uninterrupted, error-free, or continuous access to the Service. The Service may be modified, suspended, or discontinued at any time without prior notice.

Game sessions are ephemeral — once a session ends, game state is not persisted or retrievable.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Our total liability to you for any claims arising out of these Terms shall not exceed the total amount you have paid us in the twelve (12) months preceding the claim (which, as the Service is free, will be zero).

10. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

11. Governing Law

These Terms are governed by the laws of South Africa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in South Africa.
